Jane
Lynn Dellinger, relator, asks this court for a writ of mandamus directing the
Honorable W. Wayne Snodgrass, judge of the 333rd Judicial District Court of
Anderson County, Texas, to withdraw his “temporary order of transfer” of a
divorce suit and instruct the Anderson County District Clerk to transfer the
suit from the 333rd Judicial District Court to the 349th Judicial District Court
of Anderson County, Texas. We deny relator’s
request for a writ of mandamus.
Relator presents a request for a
writ of mandamus that is directed to the trial court and not this court. “To
properly seek a writ of mandamus from an appellate court, a party must seek
mandamus relief in the court of original jurisdiction—i.e., the court in which
the underlying judgment is rendered.” In
re Sw. Bell Tel. Co., 35 S.W.3d 602, 605 (Tex. 2000) (orig. proceeding). Consequently, this court has no authority to
issue a writ of mandamus against a trial court. See id.
This court’s authority to issue a writ
of mandamus against an intermediate court of appeals extends to writs of
mandamus directed to judges of a district or county court in the court of
appeals district. See Tex. Gov’t Code Ann. § 22.221(b) (Vernon 2004); see also id. § 22.221(a) (Vernon 2004). Accordingly, this court is without jurisdiction
