The U.S. District Court for the Central District of California has granted the class-action status to Gamefreak Entertainment’s claims of unfair business practices and false advertising for the company’s products, as well as similar claims regarding a number of Japanese publisher’s MMORPG games.
“This settlement will result in faster payment of compensation to anyone who bought a Gamefreak game in the past and is worth anywhere from $25 to $300, depending on the game,” said Francis T. Holden, co-lead counsel for Gamefreak. “The payment will be sent to you via check or credit card within 30 days of the court-ordered deadline. Additionally, those who bought the same game from more than one company and believe they have a viable claim for compensation, are also entitled to pursue their claims through the court.”
Gamefreak is one of the companies that violated the consumer fraud laws and false advertising laws on behalf of thousands of consumers. The company sold MMORPG games as the latest hit titles for millions of dollars in pre-orders and as Gamefreak products through its website, Gamefreak.net. However, the company’s products are unable to be played at this time as they were never fully developed. The company claims to have experienced substantial losses due to the breach of contract and fiduciary duty.
The settlement will provide monetary compensation for anyone who purchased a Gamefreak MMORPG game between March 12, 2010 and May 23, 2013.
For anyone who purchased any of the following MMORPG games as advertised on Gamefreak.net, please complete the attached Claim Form for compensation within 45 days of the date of the Court order.
