The woman, who was about 22 weeks pregnant when she arrived at the U.S.-Mexico border last November, told U.S. Customs and Border Protection agents she had been separated from her 8-year-old daughter while they were being smuggled across the Rio Grande River. Her daughter was later taken to Guatemala.

Guatemala refused to take the girl, and her mother was put into U.S. custody.

During a court hearing on the matter, the woman testified that she was raped in her home country.

The judge in her asylum case heard that testimony as well as an audio recording of an interview with a detective in Guatemala.

U.S. District Judge Dolly Gee then ordered the woman to be released from detention while the lawsuit she filed to stop the Trump administration’s new asylum policy plays out in court.
