Gregory Fish was convicted in the superior court of child molestation (based on conduct that occurred in December 1993) and making child solicitation (based on conduct that occurred in October 1994). Following a motion for new trial, the trial court vacated the molestation conviction and sentenced Fish to probation. We granted Fish’s application for discretionary appeal.
1. Fish first contends the trial court erred in denying his motion for a directed verdict. Relying on the absence of any corroborating testimony regarding the alleged child molestation, Fish contends there was insufficient evidence of a “criminal act” as required by OCGA ยง 16-6-4(a) and, therefore, there was insufficient evidence of criminal liability.
The evidence showed that Fish was a police informant, was a friend of the boy’s mother, and worked with the mother in the drug unit of the sheriff’s office. Fish was familiar with the boy and his family and had known the mother for several years, although they had a stormy relationship. The mother testified that Fish had sexual relations with her prior to the time in question and had molested the boy. At the time of the alleged molestation, the mother was pregnant with the boy’s child. When she was in her second trimester, Fish was sent to Florida by the sheriff’s office to serve an unrelated sentence. When Fish returned, he stayed in the mother’s home, and the mother left her son with Fish on a few occasions. Fish testified that he did not engage in sexual activity with the boy, but that the boy told him he “liked” to “get laid.” Fish talked to the boy on the phone and “played around” with him.
