Cleveland, Ohio, police have arrested a police officer in the fatal shooting of a black man earlier this year, and the officer has been charged with voluntary manslaughter, in what is considered to be the first conviction for a white officer in the country since 1992.

District Attorney Timothy McGinty said at a news conference Monday that no gun was found in officer Michael Brelo’s cruiser after he shot and killed 12-year-old Tamir Rice on Nov. 22. McGinty said in his press conference that Brelo used his in-car camera to record the shooting.

McGinty said that Brelo, who was cleared by a grand jury of criminal wrongdoing in the shooting, recorded a portion of the shooting after he had already fired, saying that the recording may be evidence of a possible coverup.

Brelo, a 29-year veteran of the force, has been charged with manslaughter and dereliction of duty.

McGinty said the charge of manslaughter in this case was “hard to explain.” The charge of voluntary manslaughter is usually applied when a person is in a state of passion as a result of some provocation, and the killing is not necessarily the result of a person’s decision, he said.

McGinty said the voluntary manslaughter charge was a result of the jury’s not having enough evidence to convict Brelo of aggravated murder. McGinty said that in the city of Cleveland, police officers are trained to use lethal force “when necessary” to protect themselves or others.

“In this case, that belief was not enough to convict the officer of an aggravated murder,” McGinty said.

Prosecutors said that the video was key in convincing the jury that the shooting was unnecessary and unprovoked.
